Contest Rules - “Win Big Summer Safety Contest” (“Contest”)
The sponsor of this Contest (“Sponsor”) is the Technical Standards & Safety Authority (“TSSA”).
The Contest starts at 12:01 a.m. Eastern Time (ET) on Friday, June 25, 2010 and continues until Sunday, September 26, 2010 at 11:59 p.m. (ET), the Contest Closing Date. Maximum (1) entry per unique contest promo code from a promotional wristband distributed by TSSA. Entrants that choose to answer all optional questions indicated on the contest’s entry form will automatically be entered into the Contest twice.
1. How to Enter:
1.1 No purchase necessary. There is one (1) way of entering this Contest. Visit the website www.safetyinfo.ca, click on "ENTER NOW" under the Win Big logo, then click on the link button entitled, "Enter the Contest Now" to access the electronic entry form. Complete all of the mandatory fields including but not limited to: unique contest promo code, first name, last name, address, city, province, postal code, phone number and email address. Upon completion, click "Submit" to submit your entry and you will automatically be entered into the Contest. Invalid promo codes will exclude entry from the Contest draw(s). If you choose to answer all the optional questions indicated on the contest entry form, you will automatically be entered into the Contest twice. Entries must be submitted prior to Sunday, September 26, 2010 at 11:59PM ET to be considered eligible for the Contest.
2. Prizing:
2.1 There are thirty-one (31) prizes valued at a total of approximately C$3,150, before applicable taxes, that will be awarded indvidually. The prizes available to be won include:
- two (2) 16 GB Apple iPads with Wi-Fi + 3G including a Rogers iPad micro-SIM card, with a retail value of approximately C$700 each;
- three (3) Apple iPod Touch units with a retail value of approximately C$220 each;
- seven (7) Applie iPod Shuffle units with a retail value of approximately C$70 each;
- nine (9) Apple iTunes gift cards valued at C$50 each; and
- ten (10) Apple iTunes gift cards valued at C$25 each.
2.2 Prizes are non-transferable, cannot be substituted, may not be sold, combined with any other offer or redeemed for cash.
2.3 The odds of winning depend upon the total number of eligible entries received prior to the Contest closing date of Sunday, September 26, 2010 at 11:59PM ET.
2.4 All incremental costs in using or claiming one of the prizes not outlined in this prizing description are the sole responsibility of the winner of that prize. Any costs or expenses associated with one of the prizes will be the responsibility of the winner of that prize.
2.5 Prizes must be accepted as described in these Rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part for cash, subject to the provisions set forth elsewhere in these Rules.
3. Contest Draw:
3.1 A total of thirty-one (31) random draws, by a TSSA representative or agent, from all eligible entries as of the Contest Closing Date, will be conducted on or about Monday, September 27, 2010 in Cambridge, Ontario. The selected entrants will be contacted by telephone at the telephone number indicated on each selected entrant's Contest entry.
3.2 Starting Tuesday, September 28, 2010, two (2) (one (1) per day) attempts will be made to contact each entrant selected as eligible for one of the Prizes, at the telephone number on their electronic entry between 9:00 AM and 5:00 PM ET for a period of two (2) working days. If an eligible entrant cannot be contacted within the allotted time, he/she is no longer eligible to win and another entrant will be drawn and the process of contacting the new entrant will be repeated. No communication will be entered into except with the selected entrant.
3.3 In order to be declared a winner, the selected entrant must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time-limited mathematical skill-testing question to be administered at a mutually convenient time over the telephone. There will be only one (1) opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win a prize in this Contest.
3.4 This Contest is conducted by the Sponsor and is open to: (1) all legal residents of Ontario over the age of majority in Ontario; and (2) those considered minors who are under the age of majority in Ontario. Quebec residents are ineligible to participate in this Contest. Entrants that are under the age of majority in the province of Ontario will require legal permission from their parent or legal guardian. The parent or legal guardian of such an entrant will be required to sign and return a Release & Indemnity form and correctly answer, unaided, a time-limited mathematical skill-testing question on behalf of the entrant. Should the parent or legal guardian of such a winner answer the question incorrectly, or fail to return the Release & Indemnity form, said winner will no longer be eligible to win a prize for this Contest.
3.5 Directors, officers, employees and agents of the Sponsor, their respective partners, affiliates, subsidiaries, suppliers, printers, and distributors, ("Promotion Entities") and all persons with whom they are domiciled, are not eligible to participate in this Contest.
4. Conditions of Entry:
4.1 Entrants (i) acknowledge compliance with these Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Sponsor, made in its sole discretion, which shall be final and binding in all matters relating to the Contest. Entrants who have not complied with these Rules are subject to disqualification.
4.2 Entries generated by script, macro, robotic, programming, or any other automated means are prohibited and will be disqualified. Sponsor is not responsible for late, lost, damaged, misdirected, mutilated, garbled, illegible or incomplete entries. Proof of transmission (screenshots or captures of game play etc.) and/or mailing does not constitute proof of delivery. All entries become the property of Sponsor and in no case shall be returned to the entrant.
4.3 If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address / mobile phone by an Internet access provider, online service provider, cellular phone provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
4.4 Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, or by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.
4.5 Sponsor and the Promotion Entities do not warrant that access to or use of the service will be uninterrupted. Sponsor and the Promotion Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other errors in the offering or announcement of any prize or in any prize notification documents; or (d) for any errors of any kind in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or (f) damage to a user's system occasioned by participation in the Contest or downloading any information necessary to participate in the Contest.
5. Other Conditions:
5.1 Any attempt by an entrant or other individual to deliberately damage any website or undermine the legitimate operation of the Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participant engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won.
5.2 The Sponsor reserves the right to suspend, cancel or modify the Contest at any time, if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, integrity or proper play of the Contest.
5.3 All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the legal jurisdiction and venue of the Province of Ontario.
5.4 The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, Sponsor's employees are not authorized to waive, modify or amend any provision or provisions of these Rules in any manner whatsoever.
5.5 Personal information collected from entrants will be used by the Sponsor for the purpose of administering the Contest. Sponsor will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by Sponsor to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrant consents to the manner of collection, use and disclosure of personal information as set out in the Sponsor's Privacy Policies, which are available at www.tssa.org/privacy.asp
5.6 All entry forms become the property of the Sponsor and will not be acknowledged or returned. The Sponsor will not be responsible for entry forms delayed, stolen, misdirected, lost or destroyed.
5.7 By accepting a prize in this Contest, each prize winner agrees to hold the Promotion Entities, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of the prizes. Each prize winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the prizes. By participating in this Contest, entrants agree to be bound by these Rules and the decisions of the Sponsor. All ideas submitted become the property of the Sponsor without payment of any compensation in addition to the prize award to successful entrants.
5.8 Sponsor and the Promotion Entities retain the right, in their absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of any prize or component of any selected prize for any reason whatsoever.
5.9 This Contest is subject to all Federal, Provincial and Municipal laws. Decisions of the Sponsor are final with respect to all aspects of this Contest.
5.10 Entry forms shall be subject to verification and shall be null and void if they are not obtained in accordance with these Rules. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
5.11 Sponsor reserves the right to withdraw or terminate this Contest, at any time without prior notice.
5.12 By entering the Contest, entrants, consent to the use of their name, address (city and province) and/or likeness, without further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, including the Internet, in any publicity or advertising carried out by the Sponsor relating to the Contest.
